Terms and Conditions for Online Coaching
These terms and conditions apply to the online tuition services provided by tutors at rksir.com to the students enrolled for online learning. Please read these terms and conditions carefully before enrolling in any online course and print off a copy for your records.
By enrolling in an online course, you agree to be bound by these terms and conditions, which form a legally binding contract between you and the Tutor.
1. Services
1.Services The Tutor agrees to provide online tuition services (“the Services”) to the Student in the subject and at the level specified in the enrollment form. The Services include the delivery of online lessons via a video conferencing platform, the provision of course materials, feedback, and support via email or other means.
The Tutor reserves the right to change or modify the content, format, or delivery of the Services at any time, for any reason, with or without prior notice to the Student.
The Tutor does not guarantee that the Services will meet the Student’s expectations, requirements, or learning outcomes. The Student is solely responsible for their own learning progress and results.
2. Fees and Payment
2.Fees and Payment The Student agrees to pay the fees for the Services as specified in the enrollment form or invoice. The fees are non-refundable and non-transferable, unless otherwise stated in these terms and conditions or agreed by the Tutor in writing.
The Student must pay the fees in full before the commencement of the Services, unless otherwise agreed by the Tutor in writing. The Tutor reserves the right to suspend or terminate the Services if the fees are not paid on time.
The Student must pay the fees using one of the payment methods accepted by the Tutor. The Tutor is not responsible for any fees or charges incurred by the Student as a result of using a particular payment method.
3. Cancellation and Rescheduling
3.Cancellation and Rescheduling The Student may cancel or reschedule an online lesson up to 24 hours before the scheduled start time, by notifying the Tutor via email or other agreed means. If the Student cancels or reschedules an online lesson within 24 hours of the scheduled start time, or fails to attend an online lesson without prior notice, the Student will forfeit that lesson and no refund or rescheduling will be offered.
The Tutor may cancel or reschedule an online lesson at any time, for any reason, by notifying the Student via email or other agreed means. If the Tutor cancels an online lesson, the Student will be offered a refund or a rescheduled lesson at no extra cost. If the Tutor reschedules an online lesson, the Student may accept or decline the rescheduled lesson. If the Student declines the rescheduled lesson, the Student will be offered a refund or a replacement lesson at no extra cost.
4. Conduct and Communication
4.Conduct and Communication The Student agrees to behave in a respectful and courteous manner towards the Tutor and other students during the online lessons and any other interactions related to the Services. The Student agrees not to use any abusive, offensive, or inappropriate language or behavior, or to harass, bully, or discriminate against anyone on any grounds.
The Student agrees to communicate with the Tutor and other students using only the platforms and channels approved by the Tutor. The Student agrees not to share any personal or confidential information with anyone without prior consent from the Tutor.
The Tutor reserves the right to terminate or suspend the Services if the Student breaches any of these conduct and communication rules, without any refund or compensation to the Student.
5. Intellectual Property and Confidentiality
5.Intellectual Property and Confidentiality The Tutor retains all intellectual property rights in the course materials and any other materials provided as part of the Services. The Student agrees not to copy, reproduce, distribute, publish, display, modify, create derivative works from, or exploit in any way any of these materials without prior written permission from the Tutor.
The Student agrees to keep confidential any information disclosed by the Tutor or other students during the online lessons or any other interactions related to the Services. The Student agrees not to disclose any such information to anyone without prior consent from the Tutor.
6. Disclaimer and Limitation of Liability
6.Disclaimer and Limitation of Liability The Tutor provides the Services on an “as is” and “as available” basis, without any warranties of any kind, express or implied. The Tutor disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, reliability, security, or availability of the Services.
The Tutor is not liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising from or relating to the use of or inability to use the Services, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, even if the Tutor has been advised of the possibility of such damages.
The Tutor’s total liability for any claim arising from or relating to the Services is limited to the amount paid by the Student for the Services giving rise to such claim.
7. Dispute Resolution
7.Dispute Resolution Any dispute arising from or relating to these terms and conditions or the Services shall be resolved amicably through good faith negotiations between the parties. If such negotiations fail, the parties agree to submit the dispute to binding arbitration under the rules of [insert arbitration body] in [insert location].
